1. Scope of Application
These General Terms and Conditions of Sale (“GTC”) govern sales concluded on the online shop https://agora-cancer.ch/shop/ operated by Agora, whose full contact details appear in the Site’s legal notice (the “Publisher” or the “Seller”). By placing an order, the buyer (the “Customer”) accepts these GTC without reservation.
2. Access Reserved for Members
The Site is an internal sales platform, accessible only to members of the Agora building. Access is personal and non-transferable: the Customer agrees not to share their login credentials with third parties and to make purchases only for personal use, excluding any resale. The Publisher reserves the right to suspend the access of any user who no longer meets the building membership condition or in the event of misuse.
3. Products
The Site offers clothing items and promotional objects (“goodies”). Product photographs and descriptions are provided for illustrative purposes only and have no contractual value; slight variations in color, material, or cut may occur. Products are offered subject to availability; if a product becomes unavailable after an order is placed, the Customer will be informed and fully refunded for the item in question.
4. Prices
Prices are shown in Swiss francs (CHF), VAT included. No shipping fees are charged, as items are collected exclusively on-site (see Art. 8). The Publisher reserves the right to change prices at any time; the applicable price is the one displayed at the time of the order.
5. Order
Orders are placed directly on the Site. An order is final only once payment has been confirmed (Art. 6). A confirmation email summarizing the order is sent to the Customer. The Seller reserves the right to refuse or cancel any order in the event of product unavailability, an obvious pricing error, or doubt as to the Customer’s membership status, with a full refund where applicable.
6. Payment
Payment is made exclusively online, at the time of ordering, via the Worldline Saferpay payment solution. Depending on the methods enabled, the Customer may pay by credit/debit card or TWINT.
Payment data is entered and processed directly on Worldline’s (Saferpay) secure, PCI-DSS certified infrastructure; the Seller never has access to the Customer’s complete card data. The order is only validated once payment confirmation is received from the payment provider.
7. No Statutory Right of Withdrawal
Swiss law does not provide for a statutory right of withdrawal for purchases made remotely or online. The Customer therefore has no right of return or automatic refund once an order has been confirmed, except in the cases provided for in Art. 9 (warranty against defects).
8. Collection of Items
Ordered items are neither shipped nor delivered: they must be collected in person, upon presentation of the order confirmation, at the following address: Logistics Office, 2nd floor, 265, during the following hours: Monday to Friday, 7:00 a.m. to 11:30 a.m. and 12:30 p.m. to 3:30 p.m.
The Customer is notified by email as soon as their order is ready for collection. After a period of 30 days from this notification without collection, the Seller reserves the right to cancel the order.
Risk of loss or damage to the product transfers to the Customer at the moment the item is physically handed over upon collection.
9. Warranty Against Defects
The Seller is liable for defects in the goods in accordance with the provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) relating to the warranty against defects in the item sold. The Customer is asked to check the condition of the items upon collection and to report any defect as soon as possible. The warranty excludes defects resulting from normal wear and tear, improper use, or modification of the item by the Customer.
10. Liability
To the extent permitted by law, the Seller’s liability may only be engaged in cases of intentional misconduct or gross negligence. The Seller accepts no liability for temporary interruptions to the Site due to technical or maintenance reasons.
11. Data Protection
Personal data provided when creating an account and placing an order (name, email, order history) is processed in accordance with the Federal Act on Data Protection (FADP) and our privacy policy. Payment data is processed exclusively by Worldline (Saferpay) in accordance with its own privacy policy.
12. Cookies
The Site uses technical cookies necessary for its operation (shopping cart, login, payment security).
13. Amendment of the GTC
The Seller reserves the right to amend these GTC at any time. The applicable GTC are those in force at the time the order is placed.
14. Applicable Law and Jurisdiction
These GTC, as well as any order placed on the Site, are governed exclusively by Swiss law, excluding the Vienna Convention on Contracts for the International Sale of Goods. For disputes with consumer customers, jurisdiction is determined by the Swiss Code of Civil Procedure (in particular, the defendant’s domicile or, for consumers, their own domicile or registered office).
15. Final Provisions
Should any clause of these GTC be declared invalid or unenforceable, the remaining clauses shall remain fully valid. For any questions, the Customer may contact customer service at the address indicated in the legal notice.
